Service Terms & Liability Notice.
Important information regarding our technology services, customer equipment, service authorization, data protection, warranties, and responsibilities.
Clear Expectations. Professional Service.
These Service Terms & Liability Notice ("Terms") describe general conditions governing technology services offered by Delta Tech Solutions, LLC ("Delta Tech Solutions," "we," "us," or "our").
These Terms are intended to be provided to customers before they authorize services. They apply to services when incorporated into an accepted estimate, work order, service agreement, or other documented authorization.
If a separate written agreement contains conflicting terms, that agreement controls for the relevant services. Applicable laws and non-waivable consumer rights take precedence over these Terms.
Important Notice Before Service
Technology diagnostics and repairs may involve risks to existing hardware, software, settings, and stored information. Customers should maintain current backups and disclose known equipment problems before authorizing work.
We will discuss the requested scope, known risks, and applicable charges before proceeding, subject to the circumstances of the service.
Scope of Services
Delta Tech Solutions offers technology consulting, diagnostics, repair, setup, installation, configuration, troubleshooting, maintenance, and related technical services.
Services may involve residential, commercial, institutional, and public-sector systems.
Availability depends on equipment condition, technical requirements, personnel resources, parts availability, applicable licensing, and agreed project scope.
We may decline or discontinue work that is unsafe, unlawful, outside our capabilities, or beyond an agreed authorization. Any resulting charges must comply with applicable law and the agreed terms.
Customer Authorization
Customers requesting services represent that they own the equipment or have appropriate authority to authorize the requested work.
Service authorization may permit reasonable diagnostic testing, disassembly, configuration changes, and other activities necessary to perform the approved work.
Services outside the original agreed scope, including additional chargeable repairs or replacement parts, require appropriate customer approval before proceeding.
Certain projects may require separate written authorization, particularly remote system access, data recovery, cybersecurity assessments, and business or government systems.
Diagnostics, Estimates & Pricing
Diagnostic fees, labor rates, estimates, parts costs, travel charges, and other applicable charges will be communicated as appropriate before services are authorized.
An estimate is based on the information and equipment condition reasonably known when it is provided.
Additional problems discovered during service may require a revised estimate, different parts, additional labor, or a change in the proposed solution.
We will seek approval for additional chargeable work rather than treating an initial estimate as unlimited authorization.
Customer Equipment & Existing Conditions
Customer equipment may contain previously existing defects, aging components, intermittent failures, corrosion, physical damage, or other conditions that are not apparent before inspection.
During reasonable authorized diagnostics or repairs, previously weakened or defective components may fail or previously hidden problems may become apparent.
Delta Tech Solutions is not responsible for pre-existing defects or failures that are not caused by our work.
This provision does not exclude responsibility for damage resulting from our negligence, misconduct, breach of contract, or other liability that cannot lawfully be excluded.
Data, Backups & Recovery
Customers are responsible for maintaining appropriate backups of important information before providing equipment for service, whenever reasonably possible.
Diagnostics, repairs, storage replacement, operating system installations, malware removal, and data recovery procedures may involve a risk of data alteration, corruption, or loss.
Unless separately agreed, a routine repair does not include a comprehensive backup, verification of stored data, or data recovery service.
Data recovery is not guaranteed. Recovery feasibility depends on the nature and extent of device or media damage.
Additional authorization may be required before procedures involving erasure, reformatting, destructive diagnostics, or substantial risks to stored data.
Nothing in these Terms excuses data loss caused by conduct for which liability cannot lawfully be limited.
Customer Privacy & Confidentiality
Some services may require limited access to customer files, software, user accounts, networks, or confidential information.
Such access should be limited to what is reasonably necessary for the authorized technical service.
Customers should avoid providing account passwords or sensitive credentials unless necessary and should use an agreed secure method when access is required.
Confidential business information, regulated information, and government data may require a separate written agreement and additional safeguards.
Our website privacy practices are described in our Privacy Policy.
Use of our website may involve cookies, analytics technologies, and third-party website services, including Google Analytics. Information about these technologies, associated data practices, and available privacy choices is provided in our Privacy Policy .
Remote Support & Network Access
Remote technical assistance may require temporary access to devices, applications, systems, or network settings.
Customers must authorize remote access and identify any access restrictions before a session begins.
We will perform work within the agreed scope and seek approval for material changes outside that scope.
Remote services may be affected by Internet connectivity, software limitations, device condition, security controls, and third-party systems.
Parts, Components & Third-Party Products
Repairs or installations may require new, refurbished, compatible, or customer-supplied components, as agreed.
Part availability, compatibility, manufacturer limitations, and supplier conditions may affect service outcomes.
Applicable manufacturer warranties and customer statutory rights remain in effect according to their terms and the law.
Responsibility for defective parts, installation work, and customer-supplied components will be determined under the applicable agreement and law.
Service Outcomes & Warranties
Some technical problems cannot be conclusively diagnosed or permanently resolved, particularly where equipment has multiple faults, intermittent issues, or hardware deterioration.
Any express service warranty, workmanship commitment, parts warranty, or return policy offered for a particular job will be stated in the applicable estimate, invoice, warranty document, or service agreement.
We do not guarantee compatibility, uninterrupted operation, successful data recovery, or a particular repair outcome unless expressly agreed in writing.
Nothing in these Terms limits any express warranty we actually provide, applicable implied warranties, or non-waivable consumer protections.
Payment, Deposits & Invoices
Applicable charges, deposit requirements, and payment terms will be communicated through estimates, invoices, or service agreements.
Special-order parts and project-specific purchases may require advance payment or deposits, subject to disclosure and applicable law.
Payment is due according to the agreed invoice or service terms.
Disputed charges should be brought to our attention promptly so they can be reviewed and addressed.
Equipment Pickup & Unclaimed Property
Customers will be notified when equipment is ready for pickup, additional authorization is required, or service cannot be completed.
Customers are asked to arrange pickup within a reasonable period after notification.
Any storage charges, disposition of unclaimed equipment, or other remedies must be separately disclosed and handled in compliance with applicable law.
Equipment does not automatically become the property of Delta Tech Solutions merely because it remains unclaimed.
Commercial & Government Services
Business, institutional, and government projects may require separately negotiated scopes of work, confidentiality provisions, technical requirements, security controls, or procurement agreements.
Applicable government contract terms, mandatory procurement clauses, and specific written agreements take precedence over conflicting general website terms.
Specialized testing, network security assessments, and access to protected systems require appropriate authorization.
Responsibility & Limitation of Liability
Delta Tech Solutions will seek to perform authorized services with reasonable professional care and in accordance with applicable requirements.
To the extent permitted by law, we are not responsible for failures caused solely by pre-existing defects, third-party outages, unauthorized customer changes, or other circumstances outside our reasonable control.
Any additional limitation of recoverable damages must be expressly agreed to, reasonable under the circumstances, and enforceable under applicable law.
Nothing in these Terms excludes or restricts liability that applicable law prohibits us from excluding or restricting.
Third-Party Services & Providers
Some technology solutions rely on software vendors, Internet providers, manufacturers, hosting companies, cloud services, or other third parties.
Their terms, licensing requirements, warranties, security controls, and service availability may apply.
We cannot independently guarantee uninterrupted operation or performance of systems controlled by unrelated providers.
Customer Responsibilities
Customers are expected to provide reasonably accurate information about equipment condition, known defects, requested work, and relevant system restrictions.
Customers must have authority to permit the requested work and provide necessary access to their equipment and premises.
Customers should maintain appropriate software licenses, backups, credentials, and records needed for their own systems.
Concerns & Dispute Resolution
Customers with concerns about completed work, billing, equipment condition, or service outcomes are encouraged to contact us so the matter can be reviewed promptly.
Nothing in these Terms prevents a customer from exercising applicable legal rights or seeking available remedies under Pennsylvania or federal law.
These Terms are generally interpreted under applicable Pennsylvania law, subject to mandatory laws, jurisdictional requirements, and any controlling written agreement.
Changes to These Terms
Delta Tech Solutions may revise these general Service Terms to reflect changes in services, business operations, or applicable law.
Updated terms will be posted on this page with a revised effective date.
Changes do not automatically modify previously accepted service agreements without an applicable legal or contractual basis.
